The Supreme Administrative Court has ruled to dismiss a case brought against Digital Phone Company Limited, or DPC, a subsidiary of Advanced Info Service Public Company Limited, or ADVANC, in case number 1651/2558, in which National Telecom Public Company Limited, or NT, sought compensation for the use of telecommunications equipment and networks. As a result, DPC will not have to pay 1.223 billion baht. The ruling is final. This case is one of three that NT filed against the National Broadcasting and Telecommunications Commission and DPC in the Central Administrative Court starting in 2015, seeking compensation for the temporary consumer protection period after the expiry of the 1800 MHz spectrum concession, covering 16 September 2014 to 25 November 2015. The total amount claimed from DPC across all three cases was more than 3.202 billion baht, plus interest of 7.5 percent per year. In 2022, the Central Administrative Court dismissed all three cases against DPC, and NT appealed to the Supreme Administrative Court. The remaining two cases, case numbers 918/2558 and 741/2559, with a combined disputed amount of approximately 1.979 billion baht, are still under consideration by the Supreme Administrative Court.
