Analysts from Innovest X Securities have outlined three scenarios for the Constitutional Court's ruling on the election barcode case, which will be decided on September 28, regarding whether the February 8, 2026 election is void. The first scenario, which is most likely, is that the court rules it does not violate the constitution, leading to a mildly positive reaction in the Thai stock market. The second scenario is that there are flaws but not enough to void the election, keeping the market stable. The third scenario, which is the lowest risk, is that the election is voided, creating a political vacuum that could trigger a sell-off in stocks, capital outflows, and a weaker baht. Historically, on days when the court issues rulings, the SET index tends to fluctuate by 10-15 points, with declines in cases that cause concern, such as the impeachment of former Prime Minister Srettha Thavisin and Paetongtarn Shinawatra, and gains in cases that resolve uncertainty, such as the dissolution of the Move Forward Party. Medium-to-long-term investors are advised to accumulate defensive stocks and those benefiting from new investments, while short-term traders are advised to trade within a range before the ruling day and to hold off on investing in the final week.
