The National Association of Wholesaler-Distributors has joined a 17-state coalition led by Nebraska Attorney General Mike Hilgers in filing a federal lawsuit challenging California's Plastic Pollution Prevention and Packaging Producer Responsibility Act, known as SB 54. The suit, filed in the Eastern District of California, asks the court to block enforcement of the extended producer responsibility law while the case proceeds. The coalition argues the law violates the Commerce Clause and the First Amendment by discriminating against out-of-state businesses and delegating fee-setting authority to a private entity, the Circular Action Alliance, without adequate public oversight. A federal court in Oregon earlier this year granted injunctive relief against a similar EPR law, and the merits trial in that case is scheduled for July 13 through 17, 2026. California's regulations took effect on May 1, 2026.
