The Pharmaceutical Care Management Association filed a federal lawsuit against the Illinois Department of Insurance seeking to exempt pharmacy benefit managers from the state's Prescription Drug Affordability Act. The lobby argues that the law's reporting requirements and network design restrictions conflict with the federal Employee Retirement Income Security Act and should not apply to PBMs serving employer-sponsored plans. The PDAA, signed by Governor J.B. Pritzker in July, mandates detailed annual disclosures on drug pricing and rebates and prohibits patient steering toward PBM-owned pharmacies. The PCMA claims compliance would be costly and force state-specific plan designs that ERISA's preemption clause was meant to prevent. The suit follows a similar challenge filed Monday against a Tennessee PBM reform law.
