A Texas judge vacated three provisions of the Davis-Bacon Act from the Biden administration, handing a legal win to the Associated General Contractors of America. The provisions, implemented in fall 2023, extended prevailing wage rules to materials suppliers, delivery truck drivers, and retroactively to contracts missing required clauses. The Department of Labor under President Trump did not oppose the AGC's motion for final judgment. A separate challenge from Associated Builders and Contractors over the method for determining prevailing wages remains pending in court.
