EyePoint to pay $4.6 million to settle DoJ kickback allegations

EyePoint Pharmaceuticals agreed to pay $4.6 million to resolve allegations that it paid kickbacks to certain healthcare providers to boost sales of its eyecare product Dexycu. The U.S. Department of Justice announced the settlement on Friday, stating that EyePoint paid kickbacks to certain Ambulatory Service Centers between 2019 and 2023, inducing them to purchase Dexycu in violation of the False Claims Act. The allegations involve excessive free Dexycu samples provided to the centers and an Assurance Program that reimbursed or compensated them if payors denied coverage or under-reimbursed for the drug. Assistant Attorney General Brett A. Shumate of the Justice Department’s Civil Division emphasized that kickbacks by pharmaceutical companies increase drug costs for patients and federal health care programs, and that the division will hold accountable anyone who pays unlawful kickbacks.
