The US Senate is scheduled to hold a Cloture Vote on the CLARITY Act, or Digital Asset Market Clarity Act, on September 15. It needs 60 votes to advance to formal debate. This vote is not a vote on the full bill, but merely a procedural step that would open the way to debate. Republicans currently hold a Senate majority with 53 seats, so at least 7 Democratic votes are needed. If the Cloture Vote passes, the bill will move to Senate debate and a vote before being sent to the House of Representatives, which has only 4 session days left before the session ends on September 17 and does not reconvene until after the midterm elections on November 3. If it fails, the bill will be considered dead for this session, and US crypto regulation will continue to rely on fragmented interpretations by individual agencies such as the SEC, CFTC, OCC and FASB. Cynthia Lummis, the Republican senator and key backer of the bill, warned that the next real chance for the bill to pass may not come until 2030 if members of Congress cannot reach agreement this time. The issue that has most stalled negotiations is Section 13152, which bars the president, vice president and members of Congress from issuing or promoting any digital asset while in office, with penalties of up to 250,000 dollars per day from the Department of Justice. But this restriction would expire on January 20, 2029, exactly the last day of President Trump's term. Market forecasts put the odds of the bill passing at just 16% in early September, down from 82% in February, while Galaxy Digital estimates the chance of passage at only 10%.
